WRONGFUL TERMINATION

Wrongful termination cases in California can be brought under a variety of legal theories. Generally, these include breach of contract, discrimination, retaliation and public policy violations.

If an employee has a contract of employment which specifies certain conditions under which the employment can be terminated, a breach of contract claim may arise. California also recognizes implied contracts of employment. In the absence of an express employment contract, the employee may assert that an implied contract existed whereby the employer promised that the employment would not be terminated absent just, sufficient or good cause.
