AT WILL EMPLOYMENT

California is commonly referred to as an "at-will" state. While this is technically correct, it is by no means absolute. What the California Labor Code in fact contains is a statutory presumption of at-will employment. This means that absent an express at-will agreement, the employee may attempt to prove that an implied contract of employment limiting the employers ability to terminate the employment arose.

It is important to understand that even if the employment relationship is at-will, there are many exceptions to the at-will doctrine. Whether or not an employee is at-will only has any true bearing on breach of contract claims. At-will employment status has no bearing on illegal terminations such as those involving discrimination, illegal retaliation, whistleblowers, violations of public policy, and similar tort based claims.
