EMPLOYMENT RETALIATION

Retaliation is a broad term referring to retaliatory adverse employment actions. In general, it is illegal for an employer to retaliate against an employee either where there is a constitutional, statutory or regulatory protection conferred upon the employee that directly addresses the employment relationship, or where the court finds that the retaliatory act was in violation of a legislative, administrative or judicial pronouncement of public policy.

Many constitutional, statutory or regulatory provisions refer directly to and govern the employment relationship. Where these types of provisions apply, courts generally have clearer guidance on what is and what is not permitted in the employment relationship.

Retaliation claims, however, can also be based on what is commonly referred to as public policy grounds. In that case, the employee is not asserting that they were retaliated against in violation of a particular law specifically addressing the employment relationship. Instead, they are asserting that they were retaliated against in violation of public policy.
