WHISTLEBLOWER CLAIMS

Whistleblower claims involving terminations and other adverse empoyment actions are generally similar to retaliation claims. The technical difference is indicated in the term whistleblower. In these cases, the employee has "blown the whistle" by reporting or disclosing information about a violation of law to a government or law enforcement agency.

Employer's are also prohibited from adopting rules or policies which would prevent an employee from making any such report, and employees are also protected from retaliation for refusing to engage in activities that would violate the law. Generally, in order for these protections to apply, the employee must have reasonable cause to the believe that a violation of law has occurred or would occur.

Both federal and state law recognize the need and benefit of allowing employees to report the violation of laws that are in place to protect the general public, as well as more specifically, employees, investors and shareholders.
