OVERTIME
Overtime claims are the subject of extensive litigation, both as individual claims as well as in class action lawsuits. The threshold issue in overtime litigation is whether the employee or class of employees is properly classified as exempt or non-exempt. Exempt means that an employee is exempt from the overtime laws, so does not need to be paid overtime. Conversely, non-exempt employees are not exempt from the overtime laws, and accordingly, must be paid overtime.
Disputes generally arise when employees believe they have been misclassified as exempt. For example, where an employee is given a title such as Manager, and paid a straight salary regardless of how many hours they work. If that individual works overtime but is not paid overtime due to being misclassified as exempt, they could recover damages for the unpaid overtime.
