FAMILY LEAVE

The two main bodies of law that govern family leave are the federal Family Medical Leave Act (FMLA) and the California Family Rights Act (CFRA). They both apply to employers of 50 or more employees. The term family leave, as opposed to medical leave, is generally used to refer to situations involving the employee's need for time off in order to care for a family member with a serious health condition, or for "baby bonding" either as a result of birth, adoption or foster care.

If the leave qualifies, the employee is entitled to be reinstated to the same or a comparable position except under certain circumstances.

There may be other laws addressing family leaves, and some employers may provide benefits over and above what the law requires. Family and medical leave issues are some of the most complex and frequently litigated in employment law.
