MEDICAL LEAVE

The two main bodies of law that govern medical leave are the federal Family Medical Leave Act (FMLA) and the California Family Rights Act (CFRA). They both apply to employers of 50 or more employees. The term medical leave, as opposed to family leave, is generally used to refer to situations involving the employee's own serious health condition, leaving the employee either unable to work, or unable to perform one or more essential functions of the job.

Whether or not a particular health condition qualifies as a serious health condition is subject to specific conditions. If eligible, the employee may take up to twelve weeks of leave within a twelve month period, and the leave may be taken intermittently subject to certain restrictions. If the leave qualifies, the employee is entitled to be reinstated to the same or a comparable position except under certain circumstances.

There are other laws addressing medical leaves, and some employers may provide benefits over and above what the law requires.
