BREACH OF CONTRACT
Breach of Contract claims can arise in the employment context for varied reasons. With respect to terminations, an employee with an employment contract to work for a specified duration may have protection based on terms within the contract itself, or by law.
An employee who does not have a contract to work for specific period may nonetheless assert that an implied contract arose by virtue of various factors, such as assurances given by the employer that the employment relationship would not be terminated absent good cause.
Please see the Wrongful Termination and Employment at Will pages of this website for more information on Implied Contract claims.
Breach of Contract claims can also arise in wage disputes, such as where there is a contract to pay commissions in a certain manner, as well as in other areas of the employment relationship.
