EMPLOYMENT DEFAMATION
Defamation is a common concern in employment, both from the employee's as well as the employer's standpoint. Employees often raise issues of defamation with respect to evaluations, terminations and references. Defamation requires a false statement of fact and actual damages to the reputation.
Damages are presumed, however, where the defamatory statement tends to injure one's office, trade, business or profession. This presumption means that damages arising out claims of defamation in the employment context are to some degree generally presumed. It is important to understand, however, that opinions are not actionable as defamatory, and truth is a defense to a claim of defamation.
