INVASION OF PRIVACY
Privacy in employment is protected in many respects in the employment context, but in certain aspects of the employment relationship, the privacy of the individual is subject to the justifiable business needs of the employer. In general, a claim of invasion of privacy requires that an individual have a reasonable expectation of privacy, and a that serious invasion of that privacy occurs resulting in injury or damages.
Privacy issues often arise with respect to background checks, medical and psychological examinations, drug tests, internet and email usage, relationships and associations, workplace monitoring, searches, credit checks, personnel records, etc. As evidenced by the foregoing list, privacy is a prevalent issue in the workplace.
