EMPLOYMENT CONTRACTS

Employment is California is presumed to be at-will in the absence of a contract for a specified duration of time. Contracts of employment that specify that the relationship is at-will on the other hand, generally will make the at-will relationship absolute rather than just presumed.

Most employees are not given contracts for specified durations of time, or contracts that limit the employers ability to terminate the employment relationship. Instead, most employers require that the employee sign a document acknowledging that the employment is at-will. By doing so, the employer arguably prevents the employee from asserting that an implied agreement existed that required good cause to terminate the employment relationship.

If an employee is given any type of contract purporting to govern any facet of the employment relationship, care in drafting is essential.
