NON-COMPETE AGREEMENTS

Non-Compete agreements are agreements that in some way attempt to impose limits on an employees ability to work for a competitor after their employment ends. They are generally unenforceable in California except in limited circumtances, which generally do not apply to the employment relationship. In an effort to circumvent California law, some non-compete agreements will include a choice-of-law provision purporting to make the laws of another state applicable. Generally, this will not impact the enforceability of the non-compete agreement, because in California non-competes are void as a matter of law, except again in limited circumstances.

Non-competes may be enforceable in other states, however, and employers located in such states may seek enforcement of non-competes pertaining to California employees in the state in which the company is located so as to attempt to bypass California law.
