EXEMPT VS NON-EXEMPT

Employees who are properly classified as "exempt" are exempt form the overtime laws, and accordingly do not need to be paid overtime. Conversely, employees who are properly classified as "non-exempt" are not exempt from the overtime laws, and therefor must be paid legally required overtime.

The law recognizes several exempt classifications of employee, including:

  • Executives / Managers
  • Administrative Employees
  • Professionals
  • Computer Professionals
  • Outside Salespersons
  • Commissioned Inside Salespersons
  • Artists

Each of these exemptions is subject to specific requirements and limitations. Accordingly, analysis of the particular employee's duties, responsibilities and other factors including rate of pay is essential in determining proper classification.
