DISABILITY
Both state and federal law address disability in the workplace. Under California law, an individual is considered disabled if a physical or mental impairment limits, or makes difficult, a major life activity. Many conditions qualify as a disability under this definition, but there are specific conditions which are excluded from the definition of disability.
The phrase "major life activities" is broadly construed, and includes activities such as walking, seeing, hearing, speaking, breathing and many other similar types of daily functions. Individuals who may not be technically disabled, but who have a record of disability or are regarded as disabled by the employer may also be subject to protection.
