VACATION PAY
California employers are not required by law to provide vacation benefits. If the employer does choose to provide vacation or other time off related benefits such as holidays or paid time off (PTO), there are laws that apply. Vacation is treated as a form of wages. Vacation "pay" begins to accrue, or be earned, either from the first day of employment, or alternatively, per the vacation policy established by the employer.
Once vacation pay is earned, or vested, it cannot be taken away. It must either be used or paid out. Use it or lose it policies are illegal, however, reasonable caps on the amount of vacation that an employee will be allowed to accrue are permissable. Accrued vacation must be paid out, along with any other earned wages, at the time of termination.
