CONSTRUCTIVE DISCHARGE
Resignations, in comparison to terminations, give rise to various legal issues. For example, the employer's obligation as to when the employee's final pay checks must be made available is impacted. A resignation can also impact an employee's entitlement to unemployment benefits.
Even though an employee has resigned, they may still be able to bring a wrongful termination suit. The term "constructive discharge" refers to resignations due to circumstances that are so intolerable and aggravated that the employee is compelled to resign. The term can also apply to circumstances where the employee is given a choice of quitting or being fired.
