EMPLOYMENT MEDIATION
Mediation is a form of alternative dispute resolution, a phrase which essentially means alternative to litigation or trial. Mediations generally involve an informal meeting of the parties and their counsel in the presence of a neutral third party mediator. The mediator, most often a retired judge or an attorney, is generally selected by the parties due to their knowledge of a particular area of the law and or due to their demonstrated skills as a mediator.
Mediations can be arranged privately by the parties even before a lawsuit is filed, or can be mandatory by order of the court. The primary purpose of a mediation is to settle the dispute. Mediations are generally conducted in a day, with the mediator spending the bulk of time shuffling between and meeting with the parties, located in seperate rooms, trying to facilitate a resolution of the dispute.
