EMPLOYMENT ARBITRATION
Arbitration is a form of alternative dispute resolution, a phrase which generally means an alternative to litigation or trial. Arbitration agreements have become fairly commonplace in employment, primarily due to the potential cost savings of arbitration over litigation, and the fact that through arbitration employers avoid the risk of an impassioned run away jury handing down a sizeable vedict to an employment plaintiff.
Arbitration is more formal than mediation, and is in fact much more similar to a civil lawsuit involving pleadings, discovery, and ultimately, a hearing akin to a trial, the main difference being the lack of a jury.
