PUBLIC POLICY
California employers are prohibited from terminating or taking adverse employment action against employees in violation of fundamental public policy. Public policy can be found in constitutional and statutory provisions as well as in ethical rules and regulations that are enacted under statutory authority. The provision relied upon must benefit the public rather than merely the individual, and be well established, substantial and fundamental.
Public policy claims are often times problematic for both the employer as well as the employee because what or what is not a matter of "public policy" can be difficult to assess. Whether or not a fundamental public policy is at issue in any given case can be the subject of significant dispute.
